If the paparazzo climbed over his fence - then where were his CCTV cameras looking? Was his security asleep in broad daylight? Or his housekeepers? Why does he take this to TMZ and make everyone hunt for pics instead of filing a lawsuit quietly first, for the sake of the girl? And who's "we"? Royal plural - or did he include his porn star "girlfriend" in this, who's been known to call the pap agencies, to alert them to their plans? Actually European law is much better at protecting people's right to privacy and to making the press pay fines if they did things wrong.
